International Regulation

International law has the potential to be the most effective tool with which to regulate the private security industry. But while the domestic arena suffers from an inevitably limited scope as a potential regulator of PSCs operating internationally and from deficiencies in certain state regulatory models, if there is a regulatory vacuum regarding PSCs, it exists under current international law. International regulation of PSCs would thus demand the formulation of a new legal framework.

There are no specific international laws regarding PSCs and, moreover, the status of PSCs under international humanitarian law (IHL) is unclear. The focus here is on why international law, which is mainly designed to deal with mercenaries, does not currently apply to PSCs, and on the relationship between IHL and the private security industry. An international law approach to PSCs is necessary, but will only work if it treats mercenaries and PSCs as separate rather than like entities.
